Use the site and free tools responsibly. Audits and calculators are educational estimates, not guarantees. Paid client work is governed by the specific proposal, invoice, or service agreement accepted for that engagement.
1. Acceptance of these terms
These Terms of Service ("Terms") govern your use of the Elevare Growth website, free resources, forms, audits, calculators, scorecards, booking tools, and other website features. By using the site, you agree to these Terms. If you are using the site for a company or other organization, you represent that you have authority to act for that organization.
2. Website content and free resources
Our website and free resources are provided for general business, marketing, and educational purposes. Scores, projections, benchmarks, audits, calculators, examples, recommendations, and estimated opportunities are based on the information supplied and the assumptions built into each tool.
They are not accounting, legal, tax, investment, or financial advice, and they are not a substitute for an individualized professional review. You are responsible for evaluating whether any recommendation is appropriate for your business.
3. Client services and project agreements
Paid services may include websites, landing pages, performance marketing, ad and social creative, lead-generation systems, SMS or email automation, strategy, and related marketing work. The exact scope, deliverables, fees, payment schedule, timelines, revision limits, client responsibilities, ownership rights, cancellation terms, and other project-specific conditions will be set out in the applicable proposal, statement of work, invoice, or written service agreement.
If a project agreement conflicts with these website Terms, the project agreement controls for that engagement.
4. Client responsibilities
Clients are responsible for providing accurate information, timely feedback, required account access, approvals, brand assets, and any rights or permissions needed for materials supplied to us. You are responsible for reviewing and approving final content, claims, offers, pricing, legal disclosures, and other business information before publication or launch.
You must not ask us to use materials, data, audiences, claims, or systems in a way that infringes another person's rights or violates applicable law or platform rules.
5. Fees, payments, and third-party costs
Fees for paid services are established in the applicable project agreement or invoice. Unless otherwise stated in writing, third-party costs such as advertising spend, domains, hosting, software subscriptions, stock assets, platform fees, or other external services are separate from Elevare Growth's service fees and are the client's responsibility.
Any refund, deposit, cancellation, or late-payment terms that apply to a client project will be stated in the relevant agreement or invoice.
6. Marketing and business results
Marketing outcomes depend on factors outside our control, including market conditions, pricing, competition, offer quality, sales execution, customer demand, advertising platforms, budgets, website traffic, account history, and client decisions. We do not guarantee a specific number of leads, customers, sales, revenue, profit, ROAS, ranking, conversion rate, or other business outcome unless a specific written guarantee is expressly included in a signed agreement.
Past examples, projections, case studies, calculators, or audit scores should not be interpreted as promises of future performance.
7. Third-party platforms
Our website or services may rely on third-party platforms such as hosting providers, advertising platforms, scheduling tools, analytics services, email or SMS providers, payment processors, and other software. We are not responsible for outages, policy changes, account restrictions, algorithm changes, pricing changes, or other acts or omissions of third-party services outside our control.
8. Intellectual property
The Elevare Growth name, branding, website design, original site content, templates, processes, graphics, copy, and other materials we create for our own business are owned by or licensed to Elevare Growth and may not be copied, reproduced, republished, sold, or commercially exploited without permission.
Ownership and usage rights for custom client deliverables are governed by the applicable project agreement. Until required payments are completed, any transfer of ownership stated in a project agreement may be withheld to the extent permitted by that agreement and applicable law.
9. Information and materials you submit
You remain responsible for information and materials you provide to us. You represent that you have the right to provide them and authorize us to use them as reasonably necessary to respond to your request, operate the requested tool, or perform agreed services.
10. Acceptable use
You may not misuse the website, attempt unauthorized access, interfere with site operation, introduce malicious code, scrape the site at unreasonable volume, impersonate another person, submit unlawful material, or use our content or resources to violate applicable law or another person's rights.
11. Disclaimers and limitation of liability
The website and free resources are provided on an "as is" and "as available" basis to the extent permitted by law. We do not warrant that the site will always be uninterrupted, error-free, or suitable for every purpose.
To the fullest extent permitted by applicable law, Elevare Growth will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from use of the website or free resources. Nothing in these Terms excludes liability that cannot legally be excluded or limited.
12. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. Any project-specific dispute process contained in a written client agreement will control for that engagement.
